The Baker Chic Cake Contract
DEPOSIT
A 50% deposit is due at the time of your booking of your event. A deposit of $________.____ was accepted on ____/_____/20___.
FINAL PAYMENT
Final payment is due 14 days prior to your event.
FINAL GUEST COUNT
Your final guest count (not subject to reduction) is required 14 days prior to your event. If you need to increase your guest count, every accomodation will be made by our designer to honor your request. Additional fees may be added.
PAYMENT METHODS
All prices quoted are based on cash/cashier's check/or money order. No personal checks are accepted. We apologize for this inconvenience. All client's wanting to use credit cards MC or VISA, will be assessed a non-cash payment fee of 5% the amount of the transaction.
UTAH STATE TAX
The Baker Chic charges 6.25% state taxon all goods and services. Exceptions can be made with submission of Tax ID number.
DELIVERY CHARGE
We are happy to deliver any of our creations to your home or venue. Our designer prefers to deliver to your venue at least 2 hours prior to your event in order to set up your cake display. Some cakes will require more extensive set-up time and this will be coordinated through your cake designer and your venue host. If you desire your cake to be delivered somewhere other than your venue, the Baker Chic does not assume any responsibility for the condition of the cake once it leaves the design studio. We offer complimentary delivery in SLC Valley and Bountiful Areas (please refer to map). Additional delivery fees are assessed as follows:
PROVO/OGDEN: $45
PARK CITY/TOOELE: $55
Outside these limits, we assess a $.50 / mile additional charge to cover additional security and cooling means for cakes traveling long distances.
CANCELLATION BY CLIENT
We require 30-day advance notice of cancellation in order to refund your deposit minus $100. If you do not give a 30 -day advance notice of cancellation you will forfiet your deposit and any other pre-payments that have been made. We additional assess a 10% of total cake order total for lack of considerate notification. If you cancel under this 30 day notice and reschedule your event in the next 6 months, we will gladly apply all your deposit and pre-payments to your next order.
CANCELLATION BY VENUE OR NATURAL EVENTS/DISASTER
All pre-payments and deposits are forfieted if the event is cancelled by your venue or acts of nature (i.e. fire, flood, earthquake, acts of terrorism) preventing the Baker Chic from performing your event as agreed. The Baker Chic will apply of your deposit less $100 toward another event occurrring within 6 months of your previously scheduled event. Subject to our availability. We will make every reasonable attempt to accomodate you.
CANCELLATION BY THE BAKER CHIC
The Baker Chic reserves the right to cancel this contract at any time for any reason. Should this occur greater than 30 days fro the time of your event, your deposit and any other pre-payments will be refunded in 10 business days. If the Baker Chic terminates this contract in under 30 days prior to your event date, all deposits and pre-payments will be refunded within 10 business days with an addtional 25% penalty for our late cancellation.
DAMAGE
The Baker Chic assumes NO responsibility for ANY damage or loss of merchandise, equipment, furniture, clothing or other valuables prior to, during, or after your event. We will do everything possible to ensure that all of your supplies, rentals, and equipment are cared for and maintained in good working order and without any damage.
I, ________________________________, the client, understand that by using/providing items I own (ex: toppers) or by providing hosting for an event in my home/office, that accidents/breakage and or damage may occur. I will NOT bill, charge, or sue The Baker Chef for any loss and unless the damage or loss was caused by the willful neglegent actions or conduct of The Baker Chic or its employees.
INSURANCE
The Baker Chic maintains General, Automobile, and Liability insurance, and prepares all its items in a facility that is inspected and licensed by the State of Utah and its Departments of Agriculture and Health.
ASSIGNABILITY
This contract is not assignable without the written consent of The Baker Chic
STORAGE
As cakes are created from perishable and natural ingredients, any cake delivered NOT to your venue will need immediate refrigeration unless specifically indicated otherwise by The Baker Chic. If cakes are to withstand long periods in room temperature the risk of sinking and degredation of design are high. This is especially true of summer and fall events where the cake may be outside. These accomodations will be discussed during your consultation with the designer. Extended periods of non-refrigeration also lead to the increased risk of food bourne illness and is not recommended.
RENTALS
You may provide all or part of your rental items including cake stands, toppers, etc for your event. The Baker Chic can give you an estimate cost of such rental items and include them in your total cake package. If you prefer to buy your own cake stand and have our designer use it for your display we will gladly do so with the understanding that we are not responsible for any loss or damage to such items. We may also exercise the option of buying the cake stand from you to add to our our inventory. We will offer 50% of market price for your stand. Should you use any of The Baker Chics property you will be responsible for any damage or loss and will be billed after your event.
CAKE TOPPERS/LEFT OVERS
The Baker Chich can provide a box for you to gather up any remaining cake that you would like to take off premise. We will also provide a complimentary box for your top layer keepsake cake for you to enjoy on your first anniversary. After initial delivery of the cake, toppers, or any other items created by The Baker Chic, the Baker Chic assumes no responsibility for the safety of leftovers or cake toppers or anything not eater directly on site at the event due to different food safety practices and storage at personal homes.
AGREEMENT
The agreement shall be considered accepted once both parties have signed below. It is our understanding that you are empowered by your group to make these arragements. A signature via electronic means or facsimilie is considered binding.
ARBITRATION
Any dispute, claim or controvesary arising out of or relating to this Agreement or breach, termination, enforcement, intepretation or validity therof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in the state of Utah, before one arbitrator. At the option of the first to commence arbitration, the arbitration shall be administered by the American Arbitration Association pursuant to its Commercial Arbitration Rules. Judgment on the Award may be entered in any court having jurisdiction.
This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. Allocation of Fees and Costs: The arbitrator may, in the Award, allocate all or part of the costs of the arbitration, including the fees of the arbitrator and the reasonable attorneys fees of the prevailing party.
